About Arbitration 

A fair resolution of disputes by an impartial tribunal without unnecessary delay or expense. (Section 1 Arbitration Act 1996). 

Parties are free to agree how their disputes are resolved. 

Where contracts contain an Arbitration Agreement and resultant disputes under the contract should be settled by Arbitration rather than through the Courts. 

Parties are given an equal and fair opportunity to put their case and comment upon the case of the opponent. 

The Arbitrator has the same powers as the Court to: 

  1. Order a party to do or refrain from doing something. 

  2. Order the specific performance of a contract (other than a contract relating to land). 

  3. Order rectification, setting aside, or cancellation of a contract. 

  4. Order payment of a sum of money. 

An Arbitration Award is final and binding. An Arbitrator may make an award allocating costs between the parties.
